§1 Geltung gegenüber Unternehmern und Begriffsdefinitionen

(1) Die nachfolgenden Allgemeinen Geschäftsbedingungen gelten für alle Lieferungen zwischen mir und einem Verbraucher in ihrer zum Zeitpunkt der Bestellung gültigen Fassung. Verbraucher ist jede natürliche Person, die ein Rechtsgeschäft zu Zwecken abschließt, die überwiegend weder ihrer gewerblichen noch ihrer selbständigen beruflichen Tätigkeit zugerechnet werden können (§ 13 BGB).

§2 Zustandekommen eines Vertrages, Speicherung des Vertragstextes

(1) Die folgenden Regelungen über den Vertragsabschluss gelten für Bestellungen über meine Webseite http://www.sebastian-schlueter.com .

(2) Im Falle des Vertragsschlusses kommt der Vertrag mit Sebastian Schlüter Im Brühl 11 D-71576 Burgstetten zustande.

(3) Die Präsentation der Waren auf meiner Webseite stellen kein rechtlich bindendes Vertragsangebot meinerseits dar, sondern sind nur eine unverbindliche Aufforderungen an den Verbraucher, Waren zu bestellen. Mit der Bestellung der gewünschten Ware gibt der Verbraucher ein für ihn verbindliches Angebot auf Abschluss eines Kaufvertrages ab.

(4) Bei Eingang einer Bestellung auf meiner Webseite gelten folgende Regelungen: Der Verbraucher gibt ein bindendes Vertragsangebot ab, indem er die auf meiner Webseite vorgesehene Bestellprozedur erfolgreich durchläuft. Die Bestellung erfolgt in folgenden Schritten:

1) Auswahl der gewünschten Ware 2) Bestätigen durch Anklicken der Buttons „Purchase“ 3) Prüfung der Angaben im Warenkorb 4) Betätigung des Buttons „Pay with PayPal“ 5) Nochmalige Prüfung bzw. Berichtigung der jeweiligen eingegebenen Daten. 6) Verbindliche Absendung der Bestellung durch Anklicken des Buttons „Purchase“ bzw. "Kaufen". Der Verbraucher kann vor dem verbindlichen Absenden der Bestellung durch Betätigen der in dem von ihm verwendeten Internet-Browser enthaltenen „Zurück“-Taste nach Kontrolle seiner Angaben wieder zu der Internetseite gelangen, auf der die Angaben des Kunden erfasst werden und Eingabefehler berichtigen bzw. durch Schließen des Internetbrowsers den Bestellvorgang abbrechen. Ich bestätige den Eingang der Bestellung unmittelbar durch eine automatisch generierte E-Mail („Order Confirmation“). Mit dieser nehme ich Ihr Angebot an.

(5) Speicherung des Vertragstextes bei Bestellungen auf meiner Webseite : Die AGB können Sie jederzeit auch unter http://www.sebastian-schlueter.com/agb einsehen. Ihre Bestelldaten sind aus Sicherheitsgründen nicht mehr über das Internet zugänglich.

§3 Preise, Versandkosten, Zahlung, Fälligkeit

(1) Die angegebenen Preise enthalten die gesetzliche Umsatzsteuer und sonstige Preisbestandteile. Hinzu kommen etwaige Versandkosten. Der Versand erfolgt mit DHL bzw. Der Deutschen Post.

(2) Der Verbraucher hat die Möglichkeit der Zahlung per Vorkasse (Überweisung bei Anfragen per Email) oder PayPal .

(3) Hat der Verbraucher die Zahlung per Vorkasse gewählt, so verpflichtet er sich, den Kaufpreis unverzüglich nach Vertragsschluss zu zahlen.

§4 Lieferung

(1) Ich liefere nur im Versandweg. Sofern nichts anders vereinbart, erfolgt die Lieferung aus meinem Studio an Ihre private Adresse beziehungsweise an die von Ihnen angegebene Lieferadresse. Eine Selbstabholung der Ware ist nicht möglich.

(2) Bei Produkteinfuhren in Länder außerhalb Deutschlands können Einfuhrabgaben anfallen, die Sie zu tragen haben. Diese variieren in den jeweiligen Zollgebieten. Sie sind für die ordnungsgemäße Abfuhr der notwendigen Zölle und Gebühren verantwortlich.

(3) Die Gefahr des zufälligen Untergangs und der zufälligen Verschlechterung der verkauften Sache geht auch beim Versendungskauf erst mit der Übergabe der Sache an den Käufer auf diesen über.

§5 Eigentumsvorbehalt

Ich behalte mir das Eigentum an der Ware bis zur vollständigen Bezahlung des Kaufpreises vor.

§6 Widerrufsrecht des Kunden als Verbraucher Widerrufsrecht für Verbraucher

Verbrauchern steht ein Widerrufsrecht nach folgender Maßgabe zu, wobei Verbraucher jede natürliche Person ist, die ein Rechtsgeschäft zu Zwecken abschließt, die überwiegend weder ihrer gewerblichen noch ihrer selbständigen beruflichen Tätigkeit zugerechnet werden können:

§4 Terms of Delivery

(2) Imports of products into countries outside of Germany may be subject to import duties, which you have to pay. These vary from one customs territory to another. You shall be responsible for due payment of any customs levies and duties that are necessary

§5 Retention of Title

The product shall remain my property until the purchase price has been paid in full.

§6 Right of Withdrawal

You shall have a statutory right of withdrawal.

If you withdraw from your contract, I shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by me), without undue delay and in any event not later than 14 days from the day on which I am informed about your decision to withdraw from your contract. I will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. I may withhold reimbursement until I have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
